These Terms of Service (“Terms”) govern your use of the websites, data products, and related services provided by Infinite Media Concepts, Inc. (d/b/a MailingLists.com) (“Infinite Media,” “we,” “us,” or “our”), including those offered through Databricks Marketplace, NextMark, and any other authorized marketplaces or partner platforms (collectively, the “Marketplaces”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use our Services.
- Scope of Services
Infinite Media Concepts, Inc. (d/b/a MailingLists.com) provides business, consumer, and international marketing data, analytics, and related professional services.
Our Services include—but are not limited to—data licensing, list brokerage, campaign support, audience development, and marketplace data products distributed through platforms such as Databricks Marketplace, NextMark, and other authorized partners.
- Eligibility and Account Access
Users must be at least 18 years old and have the authority to enter into binding contracts.
If you create an account, you agree to maintain accurate, current information and to protect your login credentials. You are responsible for all activity that occurs under your account.
- Orders, Payments, and Refunds
Orders may be placed through our website, via written agreement, or through Marketplaces such as Databricks or NextMark.
Fees, billing terms, and renewal conditions are stated in each applicable order or agreement.
Because our products involve proprietary or downloadable data, all sales are final once data is delivered, except where otherwise stated in writing or required by law. Refunds, if any, will be handled on a case-by-case basis.
- Data Licensing and Permitted Use
All data provided by Infinite Media Concepts, Inc. (d/b/a MailingLists.com) is licensed, not sold.
You are granted a non-exclusive, non-transferable, revocable license to use licensed data solely for lawful marketing, analytics, or research purposes.
You may not:
- Resell, redistribute, or sublicense data without written consent;
- Use data for credit, insurance, employment, or housing eligibility (as prohibited by the Fair Credit Reporting Act (FCRA));
- Use data for unlawful discrimination, harassment, or any illegal activity.
You agree to comply with all applicable laws, including the CAN-SPAM Act, TCPA, and privacy regulations such as CCPA/CPRA, GDPR, and other data protection laws.
- Marketplace Distribution
Certain datasets and audience segments may be made available through third-party marketplaces, including Databricks Marketplace, NextMark, and other authorized partners (collectively, the “Marketplaces”).
When you access Infinite Media Concepts, Inc. (d/b/a MailingLists.com) data through a Marketplace, that platform acts as a data processor, reseller, or facilitator under its own platform terms.
Your use of any data through a Marketplace is also governed by these Terms and the applicable Marketplace’s policies. In the event of a conflict, these Terms govern your relationship with Infinite Media Concepts, Inc. (d/b/a MailingLists.com).
- Intellectual Property Rights
All content, datasets, software, and documentation provided through the Services are owned or licensed by Infinite Media Concepts, Inc. (d/b/a MailingLists.com) and protected by intellectual-property laws.
Except as expressly licensed, no rights or ownership interests are transferred to you.
- Confidentiality
If you receive non-public information from Infinite Media Concepts, Inc. (d/b/a MailingLists.com), you agree to maintain its confidentiality and use it only for the intended business purpose. These obligations survive termination of your account or agreement.
- Privacy
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and disclose information.
By using our Services, you consent to our data practices as described in that policy.
- Disclaimers and Warranties
The Services and all data are provided “as is” and “as available.”
Infinite Media Concepts, Inc. (d/b/a MailingLists.com) does not guarantee that any data is complete, accurate, or error-free.
We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability
To the maximum extent permitted by law, Infinite Media Concepts, Inc. (d/b/a MailingLists.com) shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to the use of our Services, even if advised of the possibility of such damages.
Our total liability for any claim shall not exceed the amount paid to Infinite Media Concepts, Inc. (d/b/a MailingLists.com) for the specific data product or service giving rise to the claim.
- Indemnification
You agree to indemnify and hold harmless Infinite Media Concepts, Inc. (d/b/a MailingLists.com), its affiliates, officers, and employees from any claims, losses, or damages arising out of your misuse of data, violation of these Terms, or violation of applicable law.
- Termination
Infinite Media Concepts, Inc. (d/b/a MailingLists.com) may suspend or terminate your access to the Services at any time for violation of these Terms, legal requirements, or misuse of data.
Upon termination, all rights granted to you cease, and you must delete or destroy any licensed data in your possession unless otherwise authorized in writing.
- Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
- Modifications to Terms
Infinite Media Concepts, Inc. (d/b/a MailingLists.com) may update these Terms from time to time. Updates take effect upon posting to our website or Marketplace profile. Continued use of the Services constitutes acceptance of the revised Terms.
- Compliance with U.S. Data Protection and National Security Laws
By accessing, purchasing, licensing, or otherwise using any data or services provided by Infinite Media Concepts, Inc. (d/b/a MailingLists.com), you agree to comply with all applicable federal and state laws governing the use, transfer, and protection of personal data.
This includes, without limitation, compliance with the Protecting Americans’ Data from Foreign Adversaries Act of 2024 (PADFA), which prohibits the sale, transfer, or provision of U.S. persons’ sensitive data to any entity owned, controlled, or directed by a foreign adversary government (currently including China, Russia, Iran, and North Korea).
Infinite Media Concepts, Inc. (d/b/a MailingLists.com) does not sell, license, or otherwise make available personal data of U.S. persons to any foreign adversary as defined under U.S. law.
By accepting delivery of data or services, you represent and warrant that you will not use, distribute, transfer, or permit access to any data in a manner that would violate PADFA or any other applicable U.S. data protection, export-control, or national security law.
Any breach of this section shall constitute a material violation of these Terms of Service, and Infinite Media reserves the right to immediately terminate access to data, services, or accounts in its sole discretion.
